Q: I have a Garnishment and know nothing about it
A: As soon as We receive the garnishment, we send the employee copies at the address in the payroll system. If the employee didn’t get their copies, they need to talk to Payroll. Please open a ticket.
Q: How much money can you take on a garnishment?
A: The amount is case specific and can be a set amount each payday or a percentage of
disposable earnings, generally 15% to 25% of disposable earnings. For garnishments,
disposable earnings are defined as your gross income minus any legally required deductions
such as taxes and Social Security.
Q: How long will the garnishment deduction be taken out of my check?
A: By law, garnishments can go for 1 year. It will stop after 26 paydays or when the balance is zero, whichever comes first. If the garnishment is paid off sooner than 26 paydays, and another one is pending, we will start the second one immediately.
Q: What’s the balance on my garnishment?
A: Open a ticket tto request and updated payoff amount.
Q: I’m going to pay this off. How do I get the garnishment stopped?
A: We need a copy of the release of garnishment before payroll is run or the money will be deducted from the employee’s check. If the money is taken, and Disbursements hasn't mailed the check to the creditor it can be reissued to the employee.
Q: I filed for bankruptcy.
A: The employee needs to submit the Bankruptcy declaration form via email payroll@utah.gov or fax (385)465-6012. This form has the Bankruptcy case # as well as the Attorney filing info. Also the United States Bankruptcy Court Seal and Transaction Receipt.
